Terms & Conditions

As part of the Design & Development Commission, AppCodex Pvt. Ltd. takes full responsibility for maintaining, developing, and updating a client’s website or mobile app. In exchange for this service, AppCodex Pvt. Ltd. will oversee the entire project development process from start to finish.

CONTENT:

Please note that Appcodex Ltd. cannot be held liable for any information contained within The Client’s website. The content of the website remains the copyright and intellectual property of The Client. However, Appcodex Ltd. retains the right to display graphics and other web design elements as examples of their work in their respective portfolios.

TRAVEL TIME AND EXPENSES:

In case a visit or travel is necessary for a meeting, it’s worth noting that The Client will be responsible for bearing all the expenses, unless there is an agreement between both parties stating otherwise. Traveling time to and from customer premises is generally not included in our estimate.

QUOTATIONS:

The price quoted to the client is only for the work agreed upon in the initial quotation. If the client decides to request changes to the project as it progresses, we will provide a separate quote for any additional work required. In some cases, we may also need to review the timescale for completing the project.

UPFRONT PAYMENT:

Please note that an advance payment of 20% of the total cost of the project is required before any work can commence. Once work has commenced, this advance payment becomes non-refundable.

PAYMENT TERMS:

We currently accept payment by Cheques, Demand Drafts, NEFT and PayPal, unless otherwise agreed upon.

PAYMENT:

Please note that payment for the project will be due within 14 days of the invoice date. The full publication or launch of the Website/Mobile App can only take place once full payment has been received, unless otherwise agreed upon. In the event that payment is not received, any previously published or launched material may be removed. Restoring the project will require a minimum charge of US$ 50.

Accounts that have not been settled within 14 days of the invoice date will incur a late payment charge of 15% of the outstanding amount.

CONTRACT:

Please note that the client’s approval for work to commence will be considered a contractual agreement between the client and Appcodex Ltd. This approval can be given in the form of an email confirming the quote (with the quote document attached) or by signing the quote document.

It is important to note that approval for the work to commence and payment of the advance fee indicates that the client accepts the terms and conditions outlined in this document.

MATERIAL:

All material that is provided by the client will always be considered as the client’s property. We will assume that this material rightfully belongs to the client and that it does not infringe upon any copyright laws.

DOMAIN NAMES:

Appcodex offers domain name services if required. In the event that a domain name is registered by Appcodex Ltd. on behalf of a client, the domain name will be considered as the property of Appcodex until the client has paid for the domain and any professional fees involved which were previously agreed upon.

REGISTRATION CHARGES:

It is the client’s responsibility to cover all third-party costs that arise from the registration of a domain name or the purchase of third-party utilities or services. These costs are payable to Appcodex Ltd. before a formal application for registration can be made. The cost for these services is included in the standard invoice that will be issued after approval for work to commence.

COPYRIGHT:

Please be advised that in accordance with our company policy, Appcodex Ltd. will retain the copyright of any material, including design, artwork and the source code, created for the client by Appcodex Ltd. Upon receipt of the final payment, the copyright may be transferred to the client if previously agreed. Please note that Appcodex Ltd. reserves the right to retain the copyright on all material created by Appcodex Ltd. unless otherwise agreed between the two parties in writing.

PHOTOGRAPHY AND GRAPHICS:

Please note that Appcodex Ltd. reserves the right to use stock photographs and images in the design and build of the website/app. Additional images and graphics purchased from stock libraries are not typically included in the quote and will only be included once the client has approved the additional cost.

INTERNET SERVICE PROVIDER:

Please note that the customer understands and accepts that any Internet Service Provider (ASP) services or Website storage services will require a separate contract with the ISP. Appcodex Ltd. can set up a domain name with the host if required, but shall not be held responsible for any changes made by the server supplied.
